Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CR Maps platform, including the website at cr-maps.com, the web application at app.cr-maps.com, and the interactive maps and related services we provide (together, the “Service”). The Service is operated by LLC “CR Visual Lab” (“CR Maps”, “we”, “us”, or “our”).
By creating an account, embedding our maps, or otherwise using the Service, you (“Customer”, “you”) agree to these Terms. If you are using the Service on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms. If you do not agree, do not use the Service.
1. The Service
CR Maps provides interactive real-estate maps that property developers, agencies and similar businesses can configure and embed on their own websites to present projects, units, pricing and availability, and to collect enquiries (“Leads”) from their visitors. We may update, improve or modify the Service from time to time.
2. Definitions
- “Customer Content” — any data, text, images, project information, branding and other materials you upload to or configure within the Service.
- “Lead Data” — personal data of your website visitors (such as name, email, phone and message) collected through forms in your interactive maps.
- “End User” / “Visitor” — a person who interacts with a map you have published.
- “Account” — your registered access to the web application.
3. Eligibility and Accounts
3.1. You must be at least 18 years old and able to enter into a binding contract.
3.2. You are responsible for providing accurate registration information and keeping it up to date.
3.3. You are responsible for safeguarding your login credentials and for all activity that occurs under your Account. Notify us promptly of any unauthorised use.
3.4. The Service is intended for business use; it is not directed at consumers acting for personal purposes.
4. Licence and Acceptable Use
4.1. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business purposes and to embed published maps on websites you own or control.
4.2. You agree not to, and not to permit others to:
- (a) use the Service for any unlawful, misleading, or fraudulent purpose;
- (b) upload content that is illegal, infringing, defamatory, or that you have no right to use;
- (c) copy, modify, reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent permitted by law;
- (d) resell, sublicense, or provide the Service to third parties as a standalone service;
- (e) interfere with or disrupt the integrity or performance of the Service, or attempt to gain unauthorised access to it;
- (f) use any automated means to scrape or harvest data from the Service beyond functionality we expressly provide;
- (g) use the Service to store or transmit malicious code.
4.3. We may suspend or limit access if we reasonably believe these Terms are being breached or the Service is being used in a way that may harm us, other users, or third parties.
5. Customer Content and Lead Data
5.1. As between you and us, you retain all rights to your Customer Content and Lead Data. You grant us a worldwide, non-exclusive licence to host, process, transmit and display such data solely as necessary to provide and support the Service.
5.2. You are responsible for your Customer Content and Lead Data, including its accuracy, legality, and that you have all necessary rights and consents to provide it to us.
5.3. In relation to Lead Data, you act as the data controller and we act as your data processor. Our processing of personal data is described in our Privacy Policy and, for Customer Personal Data we process on your behalf, our Data Processing Agreement, which form part of these Terms.
5.4. You are responsible for informing your Visitors about how their data is collected and used, and for obtaining any consent required by applicable law.
6. Intellectual Property
6.1. The Service, including all software, design, text, graphics, logos, and the “CR Maps” name and marks, is owned by us or our licensors and is protected by intellectual property laws. Except for the rights expressly granted here, no rights are transferred to you.
6.2. If you send us feedback or suggestions, you grant us a perpetual, royalty-free right to use them without obligation to you.
7. Fees
7.1. Access to the Service and any pricing are agreed individually with each Customer under a separate written agreement. Unless such an agreement states otherwise, no fees are charged automatically through the website or application.
7.2. Where fees apply, they are governed by that separate agreement, which prevails over this section in case of conflict regarding pricing and payment.
8. Third-Party Services
The Service may rely on or link to third-party services (such as hosting, mapping, or email delivery providers). We are not responsible for third-party services, and their use may be subject to their own terms.
9. Confidentiality
Each party may receive non-public information from the other. The receiving party will use it only to perform under these Terms and will protect it with reasonable care. This does not apply to information that is public, independently developed, or required to be disclosed by law.
10. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Limitation of Liability
11.1. To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, or goodwill.
11.2. Our total aggregate liability arising out of or related to the Service will not exceed the amounts you paid to us (if any) for the Service in the twelve (12) months preceding the event giving rise to the claim, or, where no fees were paid, EUR 100.
11.3. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification
You will defend and indemnify us against third-party claims arising from your Customer Content, your Lead Data, or your breach of these Terms or applicable law.
13. Term and Termination
13.1. These Terms apply for as long as you use the Service.
13.2. You may stop using the Service and close your Account at any time.
13.3. We may suspend or terminate your access if you materially breach these Terms, or if required by law.
13.4. On termination, your right to use the Service ends. We may delete Customer Content and Lead Data after a reasonable period, subject to the Privacy Policy and any separate agreement.
14. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by posting the updated Terms with a new “Last updated” date). Your continued use of the Service after changes take effect constitutes acceptance.
15. Governing Law and Disputes
These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws rules. The parties will seek to resolve any dispute amicably; failing that, disputes will be subject to the competent courts of Ukraine, unless a separate agreement between the parties provides otherwise.
16. Miscellaneous
16.1. These Terms, together with the Privacy Policy and any separate written agreement, are the entire agreement between us regarding the Service.
16.2. If any provision is found unenforceable, the remaining provisions remain in effect.
16.3. You may not assign these Terms without our consent; we may assign them to an affiliate or successor.
16.4. Our failure to enforce any right is not a waiver of it.
